It's not fraud but they could demand repayment.

My advice- play dumb. Do nothing. If you're questioned say you didn't notice or you thought it was backpay you were owed (pretty common for people to get paid a week or two or more after the completion of a workweek). Pretend like the money doesn't exist.

Hopefully it's going to a Fidelity Cash Management Account that automatically pays 4% interest.

It IS fraud if they can prove intent. The longer you go without notifying them, the more the judge and jury turn against you. If you're honest, it may be more trouble to reclaim the money than it's worth. But if you end up with a years salary in a fidelity account, you're fucked.

Under most jurisdictions (check your local laws), this is considered an "overpayment of wages" or whatever, and they absolutely can demand repayment. The legal doctrine of unjust enrichment applies here, you can't legally keep money you didn't earn.

That said, they may write it off if it's small amounts. Either way, consult a REAL lawyer, not fucking 4chan. In the meantime, maybe put that energy into safer plays like goat on avax or some other memecoin instead if you're so interested in gambling with money, at least this way you won't get fucked unless you have shit luck and spend like a maniac.

I’m not gonna consult a lawyer over $800, it would probably cost me more in consultation fees than they actually sent me. It was just a throwaway summer job at a pretty big company chain.
