There's a couple of possibilities. One being that he was a partner in the venture, so the permits and everything came from those legally entitled to be here. I've noticed most of the stories about this deportation order have been coy with specifics and often use leading questions instead of making definitive statements. Another possibility is bribes or simply there not being a requirement in his locale to be here legally.
If it all turns out to be true, I wonder if he thought by wrapping himself up in the flag and with Trump sprayed all over everything, that would somehow protect him from immigration law? Left leaning websites push hard on the narrative that Trump is easily manipulated through vanity. Perhaps he believed that to be true and that Trump would notice his little restaurant, giving him legal status as a reward.
Or he might just be a moron.
