Part of the early Comics Code was that people who committed murder had to die by the end of the story, either via legal means (cops, executions) or karmic justice. So Joker and Lex and Doom and Magneto *attempt* things that would kill hundreds or thousands, but our overpowered heroes actually save all those lives, so they don't have to die and can be brought back later. This was justified in-universe by various no-kill rules.
So we move into the later, revised Comics Code. A lot of villains are non-threatening: How do you make things interesting? Joker kills someone and gets away with it! And the no-kill rule kinda holds water for the moment. But then next writer repeats that, and then he kills more people to "up the stakes", so you end up with someone with hundreds, if not thousands, of actual dead victims while the heroes are restrained by in-universe justifications of the CCA that doesn't matter anymore.

I don't think the problem is that Batman isn't depicted killing bad guys. It makes sense given this is a product that is for children and overgrown manchildren and they need excuses for popular villains to return. The problem is writers drawing attention to the "rules" of the franchise and having Batman justify it. It's similar to things like explaining the physics of Superman's powers or stories that exist just to explain why two decades old stories contradict each other.

Before the CCA, having a rogues gallery of supervillains didn't guarantee that they would all stick around forever in the narrative. Remember, capeshit stories were originally hero pulp stories, and any American hero story is firmly rooted in the cowboy myth. The cowboy either shoots the bad guys or locks them up in jail. Predecessors to Batman like Dick Tracy and The Shadow did just that. Most of the time, villains would die in the introductory story, or get a small story arc where they'd die at the end.

Starting in the very late 30s and early 40s, comics faced a great deal of censorship from mothers who were concerned with their sons reading graphic content. Stuff was toned down and removed, sidekicks like Robin were introduced, then the Seduction of the Innocent controversy happened and that led to the Comics Code Authority being created which fucked up the medium just like how the Hays Code did. Capeshit were the only real comics to survive this censorship, and it ended up with the metaphysics of superheroes being founded on the rules laid out by the CCA, and even today superheroes have never really shaken it off entirely.

This isn't accurate and you can look up what National and Atlas were publishing in the mid-late 50s. A lot of romance, war, western, and sci-fi/fantasy books. The cape revolution happened in the 60s and they ended up dominating the market because that's what sold the most. You can start here to see the ranking of the top selling comics from 1969-1989 https://rsmwriter.blogspot.com/2023/01/comics-sales-1969-1970.html - in 1969 there was Archie domination and plenty of romance, war and westerns, well over a decade after the code went into effect.
