It wasn't the same Spider. Miles' spider was an attempt to recreate the original one that bit Parker by Oscorp, and then Roxxon once they realized they had inadvertently created the original Spider-Man. Spider 42 was not perfect replica, hence the altered powers.

He wasn't bit by the same spider. That was Slik. His spider came from an abandoned lab and was the 42nd experiment to try to copy his powers in the comics. Spiderverse was a spider from a different universe infused with dimensional energy.
