Joker isn't really insane, just a sociopath with maybe some form of adhd and bipolar or borderline disorder.
the only major batman villains who might get away with the insanity plea is two-face, ventriloquist and maxie zeus.
some of the others might have mental disorders but they aren't insane enough to get the insanity plea and get sent to an asylum instead of regular prison.
however for the sake of making gotham an interesting fictional setting i like that they send so many of batmans villains to an insane asylum.
