As funny as this epic observation is, the issue lies with Gothams judicial system. There is no universe where criminals like Joker wouldn't get the death penalty, especially after you take into account them constantly escaping custody.

I accept Batman's stance against killing because I don't think it's really a moral one. I think it's a restriction he imposes on himself because he knows he's crazy and if he does it even once, he's never going to be able to stop. He'll always find some excuse or rationalize it in some way until one day there's an innocent body laying at his feet. And then Thomas and Martha Wayne will truly be dead, because their son betrayed everything they ever believed in.
