Based on the camera footage I don't think they would see the gate until after they turn onto that road, but it should still be fairly obvious they're going on private property so it's still their fault. Well the path next to the road is either gravel or coarse or also marked for pedestrians entirely.
Important factors for a road cyclist to not choose it.

The road has no solid line, so it is no problem for the driver to pass him on the oppisite side. On top of it the cyclist is cycling on the side, making it very easy for a car to pass.

This cyclist did nothing wrong. Rather bully cyclists who are acctually not following the rules and stuff like cycling in the middle of the road in an are where noone can pass.
