I have two more years on passport so if I renew it now I get reverted since the court order doesn't apply for some reason and if I wait I get reverted too.

the court case still is in progress and injunctions can be overturned. after federal courts only appellate and supreme court are left. Supreme court would likely meet somewhere in the middle and require documentation to update like they did from like 2010-2021
