Until the package is delivered and customer signs the final signature, it falls under Tesla. Hell, even if car is damaged after the signin, there's still warranty that covers everything for few years and then 10 years for drive train/battery itself. Then extended warranty for any other smaller stuff if you want to pay extra protection.

Yes, and that is a reasonable good faith solution and all cars repaired under such that it is satisfactory to the customer is considered new. If they take the car back under lemon law because it wasn't fixed, then thats considered damaged/used goods.

you can pursue legal action against someone if they crash your car. You wouldn't against a friend, but Tesla is not your friend - and they will legally crush anyone who claims the accident was their fault. Your insurance will not pursue Tesla, the same way they would Joe Shmoe's brother-in-law.

You can "pursue legal action" against anyone at anytime for any reason. Doesn't mean you'll win. Doesn't mean it's justified. People have sued Tesla for autopilot accidents in the past and Tesla has never been held liable. It's no different than if you summoned the car and it hit a car in the parking lot. It's still your car and it's still your responsibility and it's still your insurance that's paying for the damages. The only difference is one is driving around the parking lot and one is driving around town.
