Advice needed
having a guy at a shop do quite a bit of specialty work on my car including a fair amount of custom fab shit etc. left car at his shop and waited in "line". he got going a while later and was making good progress and his work looked really good. but now he got busy with other stuff and isn't working on it much it doesn't seem, barely even responds. the car is currently undriveable due to it not being done yet. not sure what to do here. its been a few months

I had a car sit in a shop for 8 months for a simple clutch job, and a motorcycle sit in a shop for 6 months for a wiring harness.
I do not take vehicles to shops anymore unless it requires specialty shit that I don't have access to.

In the future you ask how long they think it will take and for a rough timeframe as to when you can pick the car back up. Make it clear to them that you use and need the car and want things done in a timely manner. Then you start needling them once they get past the estimated completion date.

Your current options are essentially to either be patient or go and get your car back, depending on how much you trust this person.

yea i guess im in the needling stage right now. i think showing up with a trailer would be over the top even though its been a long time and plus then i’d need to take it to some other specialty guy to finish. i just dont know how to encourage/convince him to prioritize it and finish it. im not even out any money technically, im only paying as he completes things

The best way to get on the ass of a workman is to be honest about your initial expectations and inform them that they are not meeting them. Call and ask about the car, tell them that you had expected it to be further along than it currently is, ask them if they think that they can get back in the saddle, and inform them that if they can't you're going to have to take your business elsewhere.

It's called a verbal contract my guy. Failing to complete work in a reasonable time frame ("reasonable" as determined by the judge/jury after hearing each side's arguments), even if payment was agreed to come after the project's finished, is enough to claim financial damages, or at the very least legally bind the shop to finishing your car by a certain date lest he get fined out his ass

Verbal contracts only work in court when both parties agree about what was in it or if there was a neutral third party confirmed to be at the scene. Without any proof of the specifics of the contract a judge cannot make any confident ruling as to whether anyone is owed any sort of compensation. Additionally, given the facts as OP laid out, he himself has not lost any money because he only pays when work has been completed. His car has not been taken from him and, while it is inoperable, has not been damaged in any way and has instead been provably worked on in a way that has been satisfactory seeing as payment has been given to the worker.

You would be wasting the court's time by bringing this as a lawsuit, especially if no attempts have been made to retrieve your property without the assistance of the court.

Literally all anon needs is:
>Date that he dropped off the car
>List of mods requested
>Reasonable estimate of man-hours required to do those mods
>Proof that work has not been completed/car has not been returned to customer
All OP needs is a single email/text for the first two and fourth points and a different mechanic "expert" for the third and the shop would be fucked in court
Sure, if he wants to be nice then he can come to the shop with the evidence but if they're just not responding as he implied then fuck em

yeah i've been texting and calling. he knows im waiting but he has like 13 other fuckin projects going is the problem. pretty certain most the other jobs are more complex, high dollar stuff than my project based on what i've seen. so i get why mine is getting back-burnered its just gay
