Just by looking at this guy, I am pretty sure it was way more than just a JD Vance photo that made them send him back. I travel a lot to The US under ESTA, and considering that guy was going to stay for over 2 months in The States, he probably didnt have the funds or really a complete plan for the stay.
I also by looking at him doubt he has a job. And that is also a no no at the immigration officers since so many overstay their 90 day max stay.
This is not a US thing alone. Most countries do have these laws. ESTA gives you extremely limited options. You can basically only travel for tourism, business meetings and certain issues such as medical treatment etc. And being a tourist just for travel for over 2 months is not normal. A month in The States with hotels, car rental etc will easily set you back $20k. And for two+ months thats a year salary in The States.

I went to the US with a group, all of us except one guy had ESTA (that guy had a normal working visa for years.
We only had to be in the US for like 20 hours, guess who did the guys at the airport decide to check more thoroughly?
They checked the one guy with the normal Visa and we had to wait hours for him at the airport.

Yeah. They do check the people with regular working visa also. If you have a Green Card and travel a lot in and out of the country, there are laws and regulations for that also. Same with how long outside The States he spend during a year or the period he has a Green Card.

I have never had problems personally with US Immigration. I have been sent into secondary two times, but both times I have been first in line and it has taken less than 10 minutes both times. And both times they wanted to see if I had funds for my stay. So I just showed them from my phone and that was that.

Also regarding the guy who was sent back, I read the entire news story. And immigration found pictures of him smoking from a pipe (typical crack pipe) And that is enough for you to not enter via ESTA. So the pictures was enough.

Reading it we were actually in a legal gray zone, because we didn't worked in the US, we were just traveling to where we had to work later, but still, it was funny that only the guy who had the normal VISA was under scrutiny, they didn't even ask anything from him, just checked the data on him and maybe the bags more closely.
Although all the working gear/tools (5 extra big ~20-30 kg bags) were with him, so maybe that was the thing they found strange.
