Companies are not allowed to sponser H2-b and EB-3 visas (sort of like the more talked about h1-b) if there are qualified Americans. It is against federal law to displace US citizens. In order to get around this, companies are falsely reporting that no Americans applied or want the job. Its time to start reporting these companies.

For example, they will say the American applicants aren't qualified for some trivial make believe reason. Or they will report that the candidate told them they wanted to withdraw his application. If they didn't hire you and hired a foreigner instead, chances are they falsely reported you as being ineligible or voluntarily withdrawing your interest so they can sponser these foreigners. They are indeed stealing our jobs. Start reporting these companies for violating federal law and your rights. STate agencies, the EEOC, department of labor all have offices dealing with this. But the most directly involved would be the DOJ immigrant and employee rights section. If you even suspect a company of doing this file a report. At the very least they will start getting very nervous about falsifying these reports.
