It would not matter if they were married because if Trump married her before he starting having offspring with her because she would have been a Green Card Holder as she would have had a sponsor for it and it would have been relatively easy for her to get one. Green Card Holders are protected under the 14th amendment thanks to precedent set by The United States v. Wong Kim Ark, 169 U.S. 649 (1898)
