In The United States v. Wong Kim Ark, 169 U.S. 649 (1898) it is stated in the majority SCOTUS ruling that (emphasis mine):

If scotus rules that the children of illegals and temporary visa holders (as outlined in the Executive Order) CANNOT be US CITIZENS then that is retroactive by default because once again.... SCOTUS CANNOT MAKE LAWS, they CANNOT ALTER, AMEND, CHANGE THE US CONSTITUTION.

There's compelling reasons why the 14th was never intended to enact jus soli. It was only intended to give citizenship to freed slaves. After it was forced upon the country, Indians were still not extended citizenship.
