the law expressly forbids it. you are required to use the FLSA (fair labor standards act) definition of overtime which overrides how an employer may calculate overtime. e.g., some employers pay overtime for >8 hours in a day so you can get overtime working 3 x 12 hour shifts. the 'no tax on overtime' law would consider that $0 in overtime because 3 x 12 = 36, which is less than 40 hours a week.
