Hundreds protest outside Lakewood Police HQ demanding release of suspect accused of luring teen into van

LAKEWOOD, N.J. — A large demonstration took place late Saturday night outside Lakewood Police Department headquarters, as community members gathered to protest the arrest of Binyomin Kubani, a local father of eight and member of the Orthodox Jewish community.

The protest, which drew hundreds of participants, including the roshei yeshiva of Beth Medrash Govoha, centered on what demonstrators described as an unjust and improperly handled arrest. Kubani was taken into custody Thursday after a 15-year-old male claimed he was solicited at a Route 88 car wash.

Protesters argued the youth had previously worked for Kubani and was asked again if he wanted to assist in cleaning a van.

Kubani, who remains held at the Ocean County Jail in Toms River, was not interviewed by police prior to his arrest, nor was he permitted to provide a statement or evidence, despite having legal representation present, according to reports in Lakewood media outlets.

The Lakewood Police Department and Ocean County Prosecutor’s Office have not released a statement regarding these allegations.

A court appearance is not expected before Tuesday.

Court records show the suspect is being held in Ocean County Jail under the charge of attempting to lure a child into a vehicle.

Demonstrators voiced concerns over what they view as a breakdown in standard investigative protocol and a growing sense of mistrust between the Orthodox community and local law enforcement.

Law enforcement procedures typically involve interviewing both parties and establishing a timeline before making an arrest. In this case, protestors say that was not done.

The community is calling for a change in police leadership.

A judge has ordered the immediate release of R’ Binyomin Kubani, a Beth Medrash Govoha avreich who had been held in Ocean County Jail after being arrested last week on suspicion of attempting to lure a teenager into his vehicle — a claim his legal team says is entirely unfounded and the result of a miscommunication.

Kubani was taken into custody by Lakewood police after a Hispanic teenager alleged that the avreich had tried to lure him into a car. But according to individuals familiar with the incident, Kubani — who speaks little to no English — was simply trying to hire a day laborer to clean his car, a common practice in the area.

Whether the accusation arose from a language barrier or a deeper misunderstanding remains unclear, but the teen flagged down a passing police officer, who then arrested Kubani without taking his statement, according to his attorney.

“I call on the authorities to thoroughly investigate this matter and take necessary steps to address any wrongdoing or systemic issues that may have contributed to this arrest,” said Yosef Jacobovitch, who is representing Kubani.

Jacobovitch also criticized the conduct of Lakewood Police Detective Charles Messer, claiming he refused to take Kubani’s version of events. “I immediately contacted the department to request they speak with my client,” Jacobovitch said. “Detective Messer responded, ‘I will not let him muddy the water with his lies.’”

Further legal proceedings are expected, but as of now, R’ Binyomin Kubani has returned home.

Given no prior record of contact between Kubani and the criminal system, the letters, and the ROR recommendation from the assessment, the judge released Kubani ahead of his next court date on August 18th at 9 AM with the following conditions: Kubani is not to commit any new crimes, must appear for proceedings, must let pretrial know where he lives and provide contact information, must check in with pretrial services by phone and in person once a month, must not leave the country without approval by a judge, have zero contact with the minor complaining witness, not return to the scene of the alleged incident, and not have inappropriate contact with minors.

“The defendant then asked the victim if he would like to make some money, while motioning his hands to the act of masturbation,” Lenzi said.
