They're basically on-par with mentally retarded humans intellectually speaking, and even superior to some retardates, yet they have far less rights than them. We put them in cages and subject them to conditions which would be considered torture if it were done to a human. Our lineage has only been distinct from theirs for 6 million years, which is only 60 times greater than the time non-Africans have been distinct from Sub-Saharan Africans. It's almost certain that hybrids between humans and great apes are possible, in fact, hybrids between species which are far more dissimilar exist.
Considering how similar great apes are to humans, and how intelligent they are, I believe they should qualify for personhood, and be granted the same amount of rights that humans have. Obviously, they wouldn't be able to advocate for themselves, but much like mentally retarded humans, we would have guardians that advocate on their behalf.
