The neighbor heard a noise in the backyard, saw some shadowy figure in the other back yard, maybe thought the shovel was some kind of a weapon, thought it was a buglar, and fired. Shoot first, ask questions later. He is 110% legally screwed on this and will likely be hit with a hefty lawsuit. The kid was on his own property and not even a hint of any attempted break in.

unfortunately the downside of freedom is every low IQ brainlet is also allowed to buy a gun. this should be a case where the shooter loses their right to own guns for at least ten years so they have a chance to develop brain cells before owning another.
