The DOJ entered into a non-prosecution agreement to not prosecute Jeffrey Epstein or any of his co-conspirators, after Epstein paid fines, paid alleged victims millions, and served 13 months in prison. Despite the NPA’s promise that the United States would not prosecute any co-conspirator, the government went forum shopping and prosecuted Ghislaine Maxwell in New York, a forum that treats the NPA differently than Florida, where the agreement was made and where no further prosecution could be brought.
Maxwell’s prosecution was driven by public outrage over the unpopular NPA and Epstein’s death in federal custody. The Government, acting as though Maxwell was a proxy for Epstein, breached its own agreement, charged her with time-barred offenses, revived decades-old allegations, and worked with plaintiffs’ attorneys whose interests were largely financial. These actions were designed to pin blame for Epstein’s crimes and the Government’s failures on Maxwell, rather than upholding the foundational legal principle that the Government must scrupulously adhere to its commitments.
I won't say Ghislaine did nothing wrong, but she did nothing to deserve this, and she has been memed into a villain far out of proportion to her actual alleged offenses. She is unironically being wrongly held as a political prisoner, fresh meat fed to a mob as a distraction while the real villains skate by. If you're capable of thought and principles, this shouldn't sit well with you.
