We do not by strict standards have a Constitutional Federal Government or even a constitutional currency.
The Gray area is simply because there's no way the Founders could envision how the future looked 250 years later and so all our "Constitutional Freedumbs" were usurped because the Constitution and whatever else was re-defined as "Living documents". The Founders of America would almost certainly scrap what we now have today.
