He's probably aware that he's in trouble, and it pisses him off. Because the past is so vague, it feels unfair to him that he's being treated this way. What little he can recall of the past is rewritten in his mind to justify his actions and feelings right now. He probably vacillates between believing he'll get off then rub it all the white people's face, and quietly panicking at the thought of prison. Then he's distract himself with booze, dope, video games, and calling over some girl to fuck him.

Imagine a child with memory problems, anger management issues, impulse control issues, all packed into a man's body.
