Linus purposefully availed himself of the labour of hackers from 1993 till 2003 when he could not steal anything more from the minix source code rewrite he was doing for i386.

Linus made statements during this time:

6) "we" are all in this together and the hacker community using the hacker ethos creates something a company could not

The Hackers, including the Russian programmers who wrote ReiserFS in moscow, operated and built code in reliance on these statements of Linus.

Linus then kicked out the hackers and replaced them with feminists and corporate programmers.
Linus then implemented speech codes in the form of codes of conduct to shame and dishonour the hackers for their words and beliefs. This is constructive dissmissal
Linus kept the hackers code. The hackers detrimentally relied on his previous claims.

Purposful availment.
Detrimental reliance.
Constructive dissmissal.
