It's less of a "defense" and more of a course of action.
Whether the person is mindbroken and homicidal and actually has a broken mind and is homicidal they need to be removed from society.
One is just "we know whats wrong with you so we think we can fix it with therapy and meds" the other is "we dont know wtf is wrong with you so we'll stick you in a cage until you seem normal again and we'll parole you"

bring back lynch mobs and vigilante justice.
everything capitalist is just a vehicle for organized crime anyways.
appealing to courts and police for justice is 100% bitchmode.
they just use that to track data and add to an ever growing labyrinth of bureaucracy.
and eye for an eye tooth for a tooth is the best strategy according to game theory.
the justice system is just some fucked up subscription front that like all capitalist endeavours only care about their paychecks.
there is no justice becuase we put our faith in money.
