A Florida mom says her neighborhood Homeowners Association targeted her five-year-old son after he was seen swinging on a tree near the community bus stop.
Ariel Barner, who lives in Orlando, received a letter from an attorney representing the University Pines Property Owners Association, the HOA where she lives, which said her child Owen was 'swinging from tree branches and throwing rocks.'
The letter called Owen a 'public nuisance and annoyance to the neighborhood.' Barner was also told to pay $382 to cover the attorney's fees for drafting the letter.
'My five-year-old son has been labeled a "public nuisance" by our HOA for simply touching a tree at the bus stop,' Barner wrote on a GoFundMe page where she is asking for help with legal fees.
'Instead of compassion, we've been met with attorneys and legal threats. I'm a single mother fighting for fairness and my child's dignity — please help us defend our rights.'
Barner said on TikTok that her son was simply full of energy in the morning and was behaving like kids normally do.
'They are hyper in the mornings,' she said.
It comes as Americans are increasingly speaking up about overbearing HOAs forcing meticulous or unwritten rules on homeowners.
Barner said this all started when she told a neighbor who was disciplining her kids to 'please speak to me, not my children.' Within days she received the legal letter.
'Yes, my five-year-old was listed in a legal complaint as a "public nuisance." No prior warning, no written notice, no conversation,' she said.
'Just retaliation because I asked an adult to stop harassing my children about property that doesn't belong to them.'
She claimed the HOA is demanding she pay attorney's fees for something that was 'never documented, never proven,' and never communicated to her as a homeowner.
