What's a little less clear is if an individual STATE could declare it worthy of free speech protection - in effect giving people the right to see porn. The US Constitution says that laws cannot limit rights; it doesnt say laws cannot give GREATER rights to people.

Thats why most states still allow some sort of abortion - the states give a GREATER right to abort babies. There is no federal law saying that states may not create such a right, just a federal case saying there is not already such a federal right (to abort).

What US Congress needs to do is pass a law specifying what obscenity is: for example, "graphic, realistic depictions of nudity and sexual penetration, fluid exchange, without artistic merit, etc., whatever, " and then prosecuting anyone in the country who has this pornography, like anyone who has certain drugs.
