If capitalism inevitably regresses to psuedo-feudalism then it is indeed a capitalism problem. Competition by its nature cannot last forever. Eventually someone wins out against other competitors then uses their wealth to influence the government to put laws and regulations in place that both favor themselves and act as a barrier to new competitors. In communist countries like China this problem is resolved by government bureaucrats being a class from the merchant class and by necessity being above them and not beholden to their interests. This is why unlike in the United States where the rich can poison children and give workers cancer through unsafe practices and get away with it. In America once you get a certain amount of wealth you are not only above the law but you can use your wealth to make the law.
