Who is committing the greater crime?
a) people who have not been convicted of the crime the state accuses them of
or
b) the people in charge of the executive branch of the state who extralegally impose harsher penalties than those prescribed by law, without even having a trial
It seems that the law does not matter. Therefore, those accused of crimes cannot, by definition, even be said to have committed a crime in the first place.
