He doesn't kill because he's terrified he won't be able to stop once he crosses that line. He doesn't trust himself. and this indecision directly leads to innocents being harmed. Batman should be forced to confront that, grow, and change. but capeshit characters can't grow and change because they need to be congruent with what they were 70+ years ago and 70+ years from now because their stories are never allowed to end. they're Mickey Mouse with a cape; mascots, rather than characters.
