The issue here is illegal data (albeit encrypted) you did not deliberately request being allowed to use your node (what Hyphanet does in the background) vs an scenario where you deliberately download illegal data irrespective of intention. Plausible deniability and presumption of innocence protect you in the first case, but not in the second.
