It's mostly a formality/PR issue.
MAD does apply if you're targeting a large nuclear power or its allies. But if they don't have the capacity to take out our silos then we could lob a few over wit h the primary fallout being pissing some other countries off and a mountain of bad press.

Nuclear fallout is practically nonexistent with an airburst. It's a huge dose of radiation for what is essentially an instant.
The people telling you to worry about nuclear fallout from a nuke are uneducated or lying. This is publicly avaiable information.
