Judge a person based on the actions they do, not what they say. Furthermore, it seems more than a coincidence that Nick was the only major figure who was at the captiol, and shouting "disregard the police..." yet received no conviction or even indictment for it. So on the balance of probabilities, I would say he is a fed.
