pretty much i agree with that but there is a concern with things like parental rights (if a gay couple has kids and only one can be legally the "father") and hospital visitation and management of assets, i'm sure there's more but that's what i can think of off the top of my head, it was awful during the aids epidemic when a man couldn't be there for his partner, whatever hospitals have the only "family" can visit rule are frankly idiotic in my opinion since i'm sure lots of people would rather see the people they care about and who care about them then have visitation decision made on the arbitrary basis of shared dna not just gay people but it affects us especially. these are things the court should and will consider and the decision will most likely be made on originalist grounds so they may conclude that the federal government shouldn't be involved in this and you're right ideally they shouldn't but we don't live in an ideal world and they still have an obligation to protect the rights of gays living in red states.
