If things are really managed at the filing-court level and not escalated to specialized courts, he might actually be okay if he knows somebody (not likely, he's from a bumfuck small town) or if he somehow manages to make the right impression.
Honestly, allowing him to take the matter into a court by getting behind him to shoulder the initial legal costs might actually be the best case scenario to set a precedent against GW.
It's a trial in FUCKING SICILY of all places, about a matter so nebulous that convincing somebody who knows nothing (and doesn't care) about Space Marines and whatnot that this is real actual important business is pretty much a shot in the dark. The court bowing to the giant corporation "just because" is probably just as likely as getting a "Fuck off with this bullshit, they're not actual 1:1 replicated forgeries so I couldn't care less, REJECTED".

Also, In Italy, when you lose you usually have to pay all the legal fees of the winner too. So while this could end up crushing Ghamak forever if it goes bad for him, it might also end up being pretty hilarious if some whatever judge decides that getting bogged down with little plastic toys is not worth of his time and summarily rules agaist GW because "They're not direct copies, you have no leg to stand on".
