punishment is literally irrelevant. in judgement theres still things like restoration and theres protection of society and then way way way way way removed there's politicians arguing punishment and deterrence who are writing laws in a vacuum before they are enforced or enforceable. its a thing that is theoretically desirable but it's completely arbitrary and detached as written and completely unusable as practiced.
