Judges make the most ridiculous arguments all the time when (((they))) want to force social change.
Like Roe V Wade, the argument made was "abortion being illegal places an undue burden on the mother because she has to go to another state where it's legal if she wants to do something that's illegal here". Also btw almost all states had extremely strict abortion laws at that time related to when and why you could abort, and the judge's decision just said "fuck you I am declaring you can abort up to this period"
