Any planets you invade while under commission will be taken by your commissioned faction. I think that if you have Ashes of the Domain: Question of Loyalty installed it also applies to worlds you conquer a short time after ending your commission, but I might be wrong.
To get around this, colonize and form your own faction, then request that your faction invade a planet. Escort the invasion fleet, then once your faction lands troops you should be able to freely join the invasion and capture the world for yourself.
