We know but it literally does not matter. The FRG has no constitution, only a basic law designed by the occupying forces, mainly the US and UK. The French wanted Germany to be even more federal. It is built such that the Länder are irrelevant. This is not a confederation. Fun fact: the CSU in Bavaria originally tried to dodge signing the basic law in 1949 because they deemed it not federal enough, but cucked out because "muh voeoters". Democracy is a fraud.
