As I've gathered, though, the precedents are on your side. EA and Activision both had a big legal fight with a defense contractor (EA with Bell/Textron over the AH-1Z and UH-1Y, Activision with AM General over the Humvee). In both cases, the courts sided with the developers, but the opinions were from early stages in the litigation and I believe both settled, so there isn't really binding precedent on whether or not it counts as Fair Use. Ace Combat, you might note, is careful not to name manufacturers of the aircraft it features despite implications that they have licensed these depictions, but does use the aircrafts' names and designations. Even with favorable precedents, you can't avoid the risk of someone suing you just to get you to settle and make the problem go away, unless you can lobby Congress to give you blanket immunity from suit that makes even that not worth the plaintiff's bar's time.
