Yes, and the kid lives there too. If they weren’t paying rent they’re a licensee, basically the legal equivalent of a tenant. Even in crappy states they have to be given written notice and several days to vacate. After that period, the parents (or property owner) can file for eviction. The whole process can take several weeks (or even months depending on the state) before the police show up to physically remove someone.
