I think the way it works is that both the defense and the prosecution work together on their strategies, to bring about the outcome that they both want.
In this case, they both wanted Combs to go free, so they worked together to make prosecutorial decisions that would appear as though the state was doing its job to prosecute, but were actually making decisions that would result in the jury doing just what they've done.
