Generally it is placed upon people with notable clans, names, and power. It's not for peasants who have no name or notable clans of purpose.
Not sure how Kusuriya will go because eras/emperors means different rules and the writer is jap. But if it was say a southerner who was a cook, a hunan trader/inventory man, or just some farmers who were just transporting crops? Less likely to get the 9x-extermination.
If we go by 99% of emperors though? Treason and insurrection is the highest crime so it is very likely to be applied to the Shi clan with Shirou getting the direct sentence and a horrible death. 9x would probably extend to branch families, business ties, locals who worked with them in the plot, soldiers or close confidants, co-conspirators, all their direct families too, also possibly in-laws, in some cases close friends, etcetc.
