Discretionary and arbitrarily, both in choosing what crimes to target and how severely to target those crimes. But don't mention that. They're just automatons enforcing the will of parliament with no agency of their own. Ripe for replacement by AI if the “just following the law” crowd are right about them.
>[He] said politicians using the phrase need to think about the “dangers” they are posing to the UK’s “essential institutions”.
They undermined the justice system themselves by ensuring prison for speech and community orders for paedophiles. Simply compare the sentencing guidelines for two crimes with the same maximum sentence, and note how the unelected and unaccountable sentencing council decided which has the higher likelihood of prison. They intentionally favoured prison for the stirring up hatred offences, for instance.
>“That’s where the two-tier comes from. It is frankly disgusting to start to draw those types of comparisons.”
Moral comparisons between sentences are perfectly legitimate. If crime A is deemed worse than crime B and someone guilty of crime A receives a suspended sentence, then someone guilty of crime B should receive less. It isn't a difficult concept to grasp.
>“I think it’s offensive to our police. It’s offensive to our crown prosecutors who are trying to apply the law in the best faith. It is offensive to the courts, where independent judges are applying the law to reach the right sentences.
Good. We ought to stir hatred up against these types.
