Thing is, Steam not only have the gynormous treasure chest to absorb the chock and the developrs know it and know Steam can play the long game, but is also in the position to penalise developers who wouldn't comply to those rules way ahead of any ruling.
Most of those case would be settled before it even pass in front of a judge so it still will be on the devs anyway.
