This is completely wrong. Simple assault is used all the time for self-defense if somebody starts putting their hands on you and you punch them in the face for example or do a takedown on them. Another examples if you point a gun at somebody, that is considered assault with a deadly weapon even though you're not even touching them and in almost all cases can be used as a legitimate use of lethal self-defense in court.
You remember that case from Lubbock the guy didn't even put his hands on he just chest bumped him and was killed for it. The other guy was never charged because it was considered legitimate self-defense. Saying that it never applies in court couldn't be more wrong.
If that senator was just a regular guy off the street you better believe he would be mercilessly prosecuted for assault against a federal agent. It has nothing to do with court it has everything to do with political optics.
