Technically it isn't just muscle spasm, it is "agonal breathing". There are several different kinds based on what is causing it, such as damage to the brain stem or unconsciousness. Basically, it is an involuntary reflex that the body is performing, independent of if the person is dead or not, because the body is detecting that the brain is low on oxygen. Many cases of people mistakenly thinking a cadaver performing agonal breathing is/was still alive, or could be resuscitated/saved. Generally it is best to assume they still 'can' be saved, e.g. preforming CPR during agonal breathing until someone is pronounced dead, but yeah, in a case like this combat casualty where he's missing most of his body it's pretty clearly KIA.
