CJ Roberts does it all the time. It's part of why he controls the court effectively and part of why I like reading his opinions. He dunks on the dissenter, hard, every time. Sometimes, he even mocks the people involved in the lawsuit. He mocked Makin so hard in the Carson v. Makin case that I just laughed at it. He kept proposing all of these solutions to Maine's unconstitutional law that were borderline sarcastic. (In the case, Maine had shut down all of the public schools in a Catholic-majority area, and then banned them from using their replacement tuition vouchers for Catholic schools, so Roberts proposed a load of obviously fake solutions and ended up saying just let them go to Catholic school. Maine/Makin ultimately declared it would only allow them to go to Protestant or jewish school and not Catholic school as a so-called "compromise measure," leading to the upcoming St. Dominic Academy v. Makin case.)
