Probably is fake considering it's the jury who decides that not the judge. Though it's not impossible since our law allows "reasonable force", which is one of those vague UK law definitions that's supposed to make it more flexible but instead results in brain dead court ruling as you get brain dead jurors who can't fathom the idea that whats "reasonable" in the moment is different from the perception of some 80 IQ female juror who's sitting safe in the jury box looking at the situation from an outside perspective.
