That isn't how it works. If none of the domestic applicants are qualified, or if they can even argue that their qualifications were subjectively worse than the migrant's, they are in the clear.
In fact if the employers are getting fake resume's from domestic prospectives then they have an ironclad excuse for hiring migrants.
