the upside is that the people making the laws don't even know what a "cookie" is, and their means of pressure is always to look for companies and threaten legal action (like the UK did with 4chan). But if you have some MMO or FPS that just random people are running the server itself, the code is there and anyone can just run it (including on something like an single board computer connected to a router) then I don't see them even noticing it.
