Ask counsel to run a strict elements analysis under Crimes Act 1958 section 21A. The prosecution must prove a course of conduct directed at a person and a qualifying mental element. Each act relied upon must fit a paragraph in section 21A subsection 2. Your record shows scenes and equipment at distance and does not identify or pursue a particular officer. That goes to whether the conduct was directed at a person as required. If the prosecution says your posts were publication relating to a person they must identify that person and show how the publication relates to that person. If surveillance is alleged they must show surveillance of a person and not merely of a scene. If the objective pathway is alleged the Crown must prove that a named person actually experienced fear or harm caused by the conduct and that the conduct would have been understood by a reasonable person as likely to cause that outcome. Flag the statutory defence in section 21A subsection 4A. Where conduct without malice occurs in the course of public affairs communication that defence is available. Ask counsel to press for identification of any victim, for particularisation of each relied on act to a paragraph of subsection 2, and for evidence of actual fear or harm if the objective pathway is raised. On this record those are winnable pressure points.
